Panchayats and Municipalities — lesson overview
Rural local government
The 73rd Amendment inserted Part IX concerning Panchayats. Article 243B provides for Panchayats at village, intermediate, and district levels subject to the stated constitutional exception for the intermediate tier.
The Gram Sabha consists of persons registered in the electoral rolls relating to a village within the area of a village Panchayat. It is not simply another name for the elected Panchayat.
The Eleventh Schedule lists subjects associated with Panchayat responsibilities. Listing a subject does not automatically transfer every power; state law and actual devolution matter.
Urban local government
The 74th Amendment inserted Part IXA concerning municipalities. It distinguishes Nagar Panchayats, Municipal Councils, and Municipal Corporations for different urban settings.
The Twelfth Schedule lists municipal subjects. Urban governance also depends on state legislation, finances, planning arrangements, and other public agencies.
Do not assume every place called a city has exactly the same municipal legal structure. The constitutional categories operate through applicable law.
Elections, representation, and finance
Local bodies normally have a five-year duration. Constitutional election requirements address the expiry of that duration and premature dissolution, with specified exceptions.
The State Election Commission supervises local-body elections within the constitutional framework. The Election Commission of India is a different institution.
State Finance Commissions review local-government financial arrangements under the relevant provisions. Reservation, representation, and state devolution provisions are important parts of genuine democratic decentralisation.
Decentralisation requires functions, finances, and functionaries
The Seventy-third and Seventy-fourth Amendments established constitutional frameworks for rural and urban local government through Parts IX and IXA. The Eleventh Schedule lists twenty-nine matters and the Twelfth eighteen, but inclusion of a matter in a schedule does not automatically transfer every administrative power, employee, and rupee to each local body.
Articles 243G and 243W provide for state legislatures to endow local institutions with powers and responsibilities in the terms of the provisions. Meaningful decentralisation therefore depends on the actual transfer of functions, reliable finances, and staff capacity. A village body asked to maintain a facility without funds or control over personnel may have nominal responsibility without effective authority.
Gram Sabha means the body of persons registered in the electoral rolls relating to a village within the relevant panchayat area; it is not identical to the elected Gram Panchayat. Direct local deliberation and elected representation are complementary institutions. Their practical relationship depends on state law and implementation. In an answer, show how participation can improve information and accountability, while recognising exclusion, elite capture, and capacity problems.
Elections, reservation, and fiscal review
The general constitutional duration is five years. Elections after dissolution must follow the prescribed timing, with the specific exception where the remaining period is less than six months. A reconstituted body after premature dissolution ordinarily serves the remainder of the original term, rather than automatically beginning a fresh five-year cycle. Reading both duration and dissolution rules prevents a common mistaken inference.
The constitutional minimum reservation for women is not less than one-third of the relevant seats and chairperson arrangements as specified; several states have provided more through law. The constitutional floor and a particular state’s higher percentage are different facts. SC/ST reservation and other permitted arrangements must also be read in their respective provisions.
State Election Commissions administer the constitutionally assigned local-election functions; the national Election Commission is not the general administrator of every panchayat election. State Finance Commissions are constituted at five-year intervals to review local financial positions and recommend the specified matters. Their role differs from that of the Union Finance Commission. Reliable accounts, publication of decisions, and workable grants or revenue powers determine whether formal decentralisation translates into services and answerability.
